By purchasing, downloading or using any Odeum Sounds product, you acknowledge that you have read, understood and agree to be bound by these Purchase Terms and End-User License Agreement. These terms govern your purchase and use of all Odeum Sounds products.
Part 1: Purchase Terms
1. Digital Product – No Refunds
Due to the nature of downloadable digital products, purchases cannot be refunded once delivery or download access has begun. Refunds will not be provided except where required by applicable law, including in cases of proven fraud, unauthorized payment or a materially inaccurate product description.
By completing your purchase, you expressly consent to the immediate supply of the digital product before the end of any applicable withdrawal period and acknowledge that you lose your right of withdrawal once delivery or download access begins, except where that right cannot lawfully be excluded.
At checkout, you will be asked to confirm that you understand and accept this no-refund policy and consent to immediate delivery. A mistaken purchase, failure to review the product or system requirements, incompatibility with your system or lack of the required software does not qualify for a refund.
2. Kontakt Full Version Requirement
Odeum Sounds sample libraries require the full version of Native Instruments Kontakt. They are not compatible with the free Kontakt Player.
By purchasing a sample library from Odeum Sounds, you confirm that:
- You own a valid, activated full version of Kontakt
- You understand that the product will not function in Kontakt Player
- You have checked the product and Kontakt version requirements before purchasing
Please ensure your setup meets these requirements before checkout. A failure to meet the Kontakt or system requirements does not qualify for a refund. Before completing checkout, you will be asked to confirm your setup meets the product requirements, including that you own the full version of Kontakt.
3. System Compatibility
As the end user, you need to ensure that your system meets basic requirements:
- A compatible operating system
- A supported DAW that can host the VST version of Kontakt
- Adequate hardware performance, including CPU, RAM and storage
- The minimum required version of Kontakt, as specified on the product page
Performance may vary depending on your system configuration. System-related incompatibilities are not eligible for refunds.
4. Payments, Pricing & Availability
Payments are processed by Creem, which acts as the Merchant of Record and contractual seller for transactions. Creem is responsible for collecting payment, issuing invoices and calculating, collecting and remitting applicable sales taxes. Odeum Sounds remains responsible for the product, delivery, licensing and customer support.
All prices advertised are exclusive of applicable taxes. Depending on your country or region, VAT, sales tax, GST or other applicable taxes may be added at checkout. These taxes are calculated, collected and remitted by our Merchant of Record in accordance with local regulations.
Prices and product availability are subject to change at any time without prior notice. Purchases are final based on the price at the time of transaction. Price differences due to future discounts, promotions or pricing changes do not qualify for refunds, partial refunds, credits or price adjustments.
5. Purchase Confirmation
By completing your purchase, you confirm that:
- You have read and understood these terms
- Your system meets the necessary requirements
- You own the full version of Kontakt, where required
- You understand that Kontakt-based products will not work in the free Kontakt Player
- You accept that digital products are non-refundable once delivered
- You understand that our partner Creem acts as the Merchant of Record for the transaction
Part 2: End-User License Agreement
1. License Grant – Licensed, Not Sold
This product is licensed, not sold. “Product” means any Odeum Sounds digital audio product, including samples, recordings, Kontakt instruments, scripts, presets, patches, documentation, artwork, metadata, updates and related files.
Upon purchase, you are granted a non-exclusive, non-transferable license to use the product for personal and commercial music production. The license is perpetual unless terminated under these terms. You may use the product royalty-free in your own original musical compositions, recordings, soundtracks, trailers, games, films, videos, broadcasts, live performances and other audio or audiovisual productions.
You may install and use the product on devices you personally own or control, provided the product is used only by you and is not shared with others. You may make backup copies for your own personal archival use.
2. License Restrictions & Termination
Each license is for one person only, unless otherwise agreed in writing by Odeum Sounds. Businesses, studios, schools and other organizations must assign each license to one named user; anyone else using the product needs a separate license.
As the end user, you may not:
- Resell, share, sublicense, rent, lease, lend, transfer, gift or redistribute the product or any of its contents
- Make the product available to third parties, whether free or paid, or share it with users, collaborators or organizations that do not own a valid license
- Upload or distribute the product through file-sharing platforms, cloud storage links, forums, marketplaces or any other public or private distribution method
- Extract, isolate or distribute individual samples, sounds, scripts, patches or other product content
- Reverse engineer, decompile, bypass or interfere with any scripts, access controls or copy protection, except to the limited extent expressly permitted by applicable law
We may terminate your license if you breach these terms. If terminated, you must stop using the product and delete all product files and copies, including backups.
3. Prohibited Product Creation
You may not use this product, in whole or in part, to create, train, develop or distribute:
- Sample libraries
- Sound libraries
- Virtual instruments
- Loop packs
- Competing audio products
- AI or machine learning models, datasets or training systems
The sounds must be used as part of a larger original musical, audio or audiovisual work. You may not distribute, expose or make available the sounds in isolation, whether modified or unmodified. These restrictions apply whether the sounds are used in original, edited, processed, layered, mixed, resampled or otherwise modified form.
4. Intellectual Property
All content included in the product remains the intellectual property of Odeum Sounds or its licensors. Odeum Sounds owns or otherwise controls the rights necessary to offer the product and grant this license. This license grants usage rights only, and no ownership of the product, sounds, samples, scripts, presets, recordings or other content is transferred to you.
5. Updates & Support
Updates, fixes or additional content may be provided over time at the discretion of Odeum Sounds. Minor bugfix updates are 100% free for all existing users. If you're subscribed to the newsletter, you'll receive an email when product updates are available.
We aim to respond to customer-support requests within three business days. For delivery issues or technical assistance, please contact support@odeumsounds.com.
6. Limitation of Liability
The product is provided “as is,” without warranties of any kind. Odeum Sounds does not guarantee that the product will be error-free, uninterrupted or compatible with every DAW, operating system, plugin format, sampler, hardware setup or future software update.
Odeum Sounds is not responsible for technical issues, incompatibilities, data or project loss, lost income or profits or any indirect or consequential damages related to the use of, or inability to use, the product. Nothing in these terms excludes or limits any statutory warranty, conformity right, consumer remedy or liability that cannot lawfully be excluded or limited.
7. Governing Law
This Agreement is governed by the laws of France, without regard to conflict of law principles. If you are a consumer, this does not affect any mandatory consumer protection rights that apply under the laws of your country of residence.
